Terms and Conditions

1. Acceptance of Terms

By accessing and using the services provided by Afrilink Telecoms (Pty) Ltd (Registration No. 2018/238217/07), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services Provided

Afrilink Telecoms provides:

  • Web hosting services
  • Domain registration and management
  • Fiber internet installation and connectivity
  • Email hosting services
  • Technical support and maintenance
  • Related telecommunications services

3. Account Registration and Responsibilities

3.1 Account Creation

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • One person or entity may not maintain multiple accounts for the same service

3.2 Acceptable Use

You agree not to use our services for:

  • Illegal activities or content that violates South African laws
  • Spamming, phishing, or other malicious activities
  • Copyright infringement or intellectual property violations
  • Activities that may harm our infrastructure or other users
  • Excessive resource consumption beyond fair usage limits

4. Payment Terms

4.1 Billing

  • All prices are in South African Rand (ZAR) and include VAT where applicable
  • Services are billed in advance on a monthly or annual basis
  • Payment is due within 7 days of invoice date
  • Late payments may result in service suspension

4.2 Refunds

Refunds are provided at our discretion and may be subject to setup fees and pro-rata calculations. Domain registration fees are generally non-refundable due to third-party costs.

5. Service Level Agreement (SLA)

5.1 Uptime Guarantee

We strive to maintain 99.9% uptime for our hosting services. SLA credits may be available for qualifying outages as defined in our SLA policy.

5.2 Support

  • Technical support is available 24/7 for critical issues
  • Support response times vary based on service level and issue priority
  • Support is provided in English and Afrikaans

6. Data and Backups

While we provide backup services as part of our hosting packages, you are ultimately responsible for your data. We recommend maintaining your own backups for critical data.

  • Daily automated backups are provided for hosting services
  • Backup retention periods vary by service plan
  • Data recovery requests may incur additional charges
  • We are not liable for data loss due to circumstances beyond our control

7. Domain Registration Terms

  • Domain registrations are subject to the policies of the respective registries
  • You are responsible for keeping domain contact information current
  • Domain renewals are your responsibility; expired domains may be deleted
  • Disputes over domain ownership are subject to applicable domain dispute policies
  • Transfer of domains may be subject to registry lock periods and transfer fees

8. Fiber Installation and Connectivity

8.1 Installation

  • Fiber installation is subject to area coverage and technical feasibility
  • Installation appointments require customer presence
  • Property access and permissions are customer responsibilities
  • Installation may require additional time for complex setups

8.2 Service Delivery

  • Fiber speeds are subject to network conditions and fair usage policies
  • Equipment remains property of Afrilink Telecoms unless purchased
  • Service interruptions may occur for maintenance and upgrades

9. Limitation of Liability

To the maximum extent permitted by South African law:

  • Our liability is limited to the amount paid for services in the preceding 12 months
  • We are not liable for indirect, consequential, or punitive damages
  • We do not guarantee uninterrupted service or complete security
  • Force majeure events may excuse performance obligations

10. Termination

10.1 By Customer

You may terminate services with 30 days written notice. Termination does not relieve you of obligations for charges incurred prior to termination.

10.2 By Afrilink Telecoms

We may terminate services immediately for breach of terms, non-payment, or illegal activities. We will provide reasonable notice for non-breach terminations.

11. Intellectual Property

  • You retain ownership of your content and data
  • You grant us necessary licenses to provide services
  • Our service marks, trademarks, and proprietary technology remain our property
  • You must respect third-party intellectual property rights

12. Governing Law and Disputes

These terms are governed by South African law. Disputes will be resolved through:

  • Good faith negotiation as the first step
  • Mediation if negotiation fails
  • Arbitration or South African courts as final resort
  • Jurisdiction in Johannesburg, Gauteng

13. Modifications

We reserve the right to modify these terms with 30 days notice. Continued use of services after modifications constitutes acceptance of the new terms.
